Introduction

Below are our terms. These always apply when you use our website or register for the digital service Soulwise Yoga. They contain important information for you as a user/customer. Therefore, we suggest that you read the terms carefully.

These terms apply when subscribing to Bliss Experiences AB (“Soulwise Yoga”), org. nr 559337-0165, a digital service aimed at yoga teachers (“the service”). The terms govern the use of the service.

Your rights are protected in accordance with the applicable consumer legislation in your home country. We strive to meet all local requirements and regulations, including but not limited to the right of withdrawal, warranties, and the right to file complaints, to ensure fairness and transparency. Here are some links to some of the most important international consumer protection laws:

We will acknowledge the agreement via email. You are responsible for providing a correct email address when creating your user account. If you do not provide a correct email address, we will not be able to acknowledge the agreement and activate your account.

To use the service, access to the internet and necessary equipment are required. To become a customer of Soulwise Yoga, you must be of legal age and have the right to enter into an agreement on your own behalf. Persons who are not of legal age, or are under guardianship, can only use the service if a guardian or custodian signs the agreement with Soulwise Yoga. The guardian or custodian is then responsible for the minor’s use of the service as if it were their own.

Description of the Service and User Account

Soulwise Yoga provides a digital service for yoga teachers (“the customer”) where they can plan their yoga classes and share knowledge with other yoga teachers.

The content of the service is continuously developed and changed, and Soulwise Yoga reserves the right to from time to time change and revise the offerings and availability for the customer.

The quality of the customer’s use of the service is also affected by a number of factors beyond Soulwise Yoga’s control, such as the customer’s connection, equipment, location, available bandwidth, and/or the customer’s internet connection speed. Therefore, Soulwise Yoga cannot provide any guarantees regarding the customer’s ability to connect to and access the service, or the quality of the service the customer can access.

The customer must register and create a user account to access the service.

Customer Use of the Service

Unless otherwise stated, the subscription and all content displayed through the service are for the customer’s personal and non-commercial use. The service is non-exclusive and non-transferable.

The customer is not entitled to copy, photograph, film, archive, download (except for caching necessary for personal use), reproduce, distribute, modify, display, perform, publish, license, offer for sale, or use (except as explicitly allowed in the Agreement) any content or information found on or obtained from or through the service without written permission from Soulwise Yoga.

No rights, ownership, or any other rights related to Soulwise Yoga or its service are transferred. The customer also commits to using the service in accordance with all applicable laws, regulations, and rules and not in violation of the Agreement or other restrictions.

The customer must not circumvent, remove, alter, impair, or thwart any content protections on the service; use any robot, spider, scraper, or other automated means to access the service; decompile, reverse engineer, or disassemble any software or other products or processes accessible through the service; or insert any code or product to manipulate the content on the service in any way or use data mining, data collection, or any other extraction method.

Additionally, the customer agrees not to upload, post, email, or otherwise send or transmit any material designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment associated with the service. This includes any software viruses or any other computer code, files, or programs. The customer is also responsible for ensuring that any communication with Soulwise Yoga or other customers within the framework of Soulwise Yoga’s service complies with applicable law.

The customer must express their opinions respectfully and not use words or phrases that may be perceived as discriminatory, offensive, or abusive in forums associated with Soulwise Yoga. Additionally, the customer is responsible for not using or sharing content or comments likely to be illegal or defamatory, or material that contains or encourages criminal behavior in any form.

Password and Account Access

Upon entering into the Agreement, the customer creates an account, which provides access to and control over the service via the account. The customer is thereafter responsible for their account and associated password, ensuring it is not used without authorisation. If the customer forgets their password, it can be updated via the service’s login page.

Soulwise Yoga reserves the right to monitor the usage of the account. The customer is responsible for ensuring that the password is not shared with or used by anyone other than the customer and for updating and maintaining the information provided to Soulwise Yoga linked to the account.

The customer must be vigilant about any communication requesting payment or bank account information to prevent fraud or identity theft. Soulwise Yoga informs customers that it will not request such information except at the time of entering into the Agreement, or when changing or renewing the payment method, or for direct purchases via Soulwise Yoga; and then only through its payment service provider.

For the customer’s security, it is advised to ensure that they are on the Soulwise Yoga website when subscribing or making purchases.

Soulwise Yoga also reserves the unrestricted right to block a user account at any time, with or without notice to the account holder, to protect Soulwise Yoga and other customers from suspicious activities, such as fraud.

Trial Period, Cancellation Right and Terms of Agreement

Soulwise Yoga offers a 14-day free trial period for the service.

The right of withdrawal according to applicable consumer laws (such as the Distance and Doorstep Sales Act (2005:59) in Sweden and equivalent international regulations) applies during the same period as the trial period. The customer must notify the cancellation within 14 days to retain the right of withdrawal.

The subscription takes effect after the end of the trial period, and the customer is responsible for paying according to the applicable prices and payment terms.

Remedies for Errors by Soulwise Yoga

Soulwise Yoga does its best to update the content on the website when necessary. Despite the care taken by Soulwise Yoga, it is possible that the content may be incomplete and/or incorrect. All material on the website is without warranty or claim to accuracy. The material can be changed at any time without notice.

In the event of a delay or error on the part of Soulwise Yoga (such as prices and other information), the customer can only demand rectification, primarily in the form of remedying the error in an appropriate manner; for example, fulfilling Soulwise Yoga’s commitments within a reasonable time.

Regarding the customer’s right to cancel the purchase due to errors or delays, as well as any damages, reference is made to the same law. However, the customer is not entitled to any compensation other than that which follows from applicable legislation, due to errors or cancellations.

The customer can never make other claims against Soulwise Yoga than those that follow from the Agreement or applicable legislation in the event of errors or delays by Soulwise Yoga. Additionally, Soulwise Yoga and the customer have specifically agreed that the customer can never, under any circumstances, make claims against Soulwise Yoga for business losses, damages, or other indirect damages that Soulwise Yoga is considered to cause the customer. Prices, Payment and Payment Information

Prices and payment terms are specified on the Soulwise Yoga website.

For the customer to enter into an Agreement and obtain a subscription, a valid payment method must be registered. By subscribing and registering and approving a payment method, the customer thereby authorises Soulwise Yoga to charge the current payment method according to the Agreement and the prevailing price at the time. The same applies if the customer has subscribed to Soulwise Yoga through a voucher code, requiring a regular payment method as a complement during registration.

Soulwise Yoga also reserves the right to renew the subscription at the end of the contract period and automatically charge the customer in advance on the calendar day corresponding to the day the customer’s Agreement was signed. However, Soulwise Yoga reserves the right to change the billing date. When billing, i.e., renewing the subscription, each Agreement will be legally renewed as an Agreement without promotional prices and/or discounts.

Changes in prices are notified in advance, for example, via the website and/or email, and the customer is responsible for staying informed about any changes.

Updating the payment method, viewing receipts, etc., is handled by the customer via a customer portal. A link to this is found in the customer’s profile page in Soulwise Yoga, under the subscription tab. To access this, the customer needs to be logged in to Soulwise Yoga.

Termination and Cancellation of Subscription

The customer must actively cancel the subscription before it renews each month or year (depending on the chosen subscription) to avoid being charged for the next subscription period. Cancellation is done on the customer’s profile page, under Account (Subscription tab). To access this, the customer needs to be logged in to Soulwise Yoga.

The subscription fee is earned in full by Soulwise Yoga at the time of payment, and once payment has been made, no refund is given. After a subscription is cancelled, the customer has access to the service until the end of the current billing period. If a payment cannot be drawn due to the customer’s payment method not functioning, Soulwise Yoga has the right to immediately terminate the Agreement. Regardless, Soulwise Yoga reserves the right to request payment from the customer, whereby the customer cannot terminate the Agreement simply by deregistering the payment method.

Soulwise Yoga also reserves the right to terminate the customer’s subscription for violations of these purchase terms.

The customer can access information about their ongoing subscription at any time by logging into the service and visiting their profile page.

Personal Data and Privacy

The customer agrees and consents to any personal data provided to Soulwise Yoga being processed by Soulwise Yoga to fulfill the Agreement or obligations under law or other regulation. The customer is responsible for ensuring that the data provided during registration is correct and that personal data, including the email address, is correct. The customer is also responsible for updating such information if it changes.

Furthermore, the customer is informed and consents to the personal data being used for market analysis, statistical analysis, and to evaluate and inform about services and products. Personal data may also be processed for marketing purposes by both Soulwise Yoga and Soulwise Yoga’s partners.

Soulwise Yoga processes the customer’s personal data in accordance with applicable data protection legislation. The customer consents to Soulwise Yoga’s Privacy policy.

Limitation of Liability and Customer Obligations

The customer is responsible for having the necessary equipment and internet connection to use the service.

The customer acknowledges and unconditionally agrees that they are personally responsible for how Soulwise Yoga’s services and content are used and that they are physically and mentally fit to use or apply the content. This also applies to the customer’s clients (“yoga students”).

Soulwise Yoga always recommends that the customer or their yoga students first consult a doctor if there is any doubt about their own or their yoga students’ ability to safely use Soulwise Yoga’s service content. Soulwise Yoga further disclaims all responsibility for assessing injuries and illnesses and whether they entail any risks and limitations for the customer or their yoga students, as well as for injuries or other ailments that occur for the customer or their yoga students in connection with the use of the service. Soulwise Yoga is also never responsible for ensuring that advice and suggestions for yoga sequences are tailored to the customer’s or their yoga students’ conditions, and therefore takes no responsibility for the results that can be achieved for the customer or their yoga students. All use of Soulwise Yoga’s services is thus entirely at the customer’s or their yoga students’ own risk.

Force majeure

Soulwise Yoga is never liable for indirect damages or losses, operational losses, or loss of profit, production losses, losses due to missed or broken contracts with third parties, or similar. Soulwise Yoga is also not responsible for errors or interruptions that can be traced to other service providers.

Soulwise Yoga further disclaims liability to the customer for fulfilling its obligations under the Agreement during major incidents beyond Soulwise Yoga’s control. These include (but are not limited to): fire, war, military actions, pandemic or government measures resulting from such conditions, riots, strikes, lockouts, natural disasters, including lightning and floods, major disruptions or disturbances in technical systems or IT systems that Soulwise Yoga could not avoid or overcome without unreasonable costs, or that Soulwise Yoga could not foresee when the Agreement was entered into.

Rights

Soulwise is a registered and protected trademark in the EU. Soulwise Yoga and its service, including all material and content provided by Soulwise Yoga (such as logos, designs, images, films, texts, and content), are protected by Swedish and international copyright laws, trade secret laws, and other laws and conventions for intellectual property rights.

The customer receives no rights to Soulwise Yoga’s material or other documents, and information that the customer accesses through Soulwise Yoga outside of using the service under the Agreement. The customer’s access to and right to use the content also ends immediately when the Agreement terminates.

Soulwise Yoga reserves the unrestricted right within the framework of the service to use all the customer’s comments, information, ideas, concepts, reviews, techniques, or other material found in communications that the customer sends or otherwise communicates to Soulwise Yoga or within the service, including responses to surveys or postings, including on Soulwise Yoga’s website and other channels such as social media. This applies for all time and without the customer having the right to compensation, acknowledgment, or payment including (but not limited to) for Soulwise Yoga to develop, manufacture, and market products and create, modify, or improve the service.

The customer also agrees not to invoke other rights or feedback from Soulwise Yoga. Soulwise Yoga also disclaims any obligation to accept material or ideas and is not responsible for similarity with content or programs, in any media format, with material or ideas sent to Soulwise Yoga. If the customer sends material or ideas without prior request, the customer does so with full understanding that they waive the right to make claims against Soulwise Yoga, even if material or ideas may be used by Soulwise Yoga.

Changes to Terms and Conditions

Soulwise Yoga reserves the right to change these Terms and Conditions with prior notice to the customer.

The customer is responsible for regularly reviewing these Terms and Conditions to stay informed about any changes.

Governing Law and Dispute Resolution

These purchase terms are for users within the EU interpreted in accordance with Swedish law and do not restrict the customer’s rights under mandatory legislation.

For users outside the EU, other laws may apply depending on the customer’s location. Any disputes shall primarily be resolved through negotiation. In the absence of an agreement, the dispute will be referred to the Swedish general court. Users also have the option to have any dispute reviewed by the Swedish General Complaints Board (ARN). The customer may also have the opportunity to seek advice from a consumer advisor.
